Mr. Colmary is a member of the wholesale shoe manufacturing firm of A. G. Colmary 307 West Mulberry street, and William L. Marbury and William S.

Bryan, are his attorneys. Mr. Colmary's diaries, which his wife 6ays furnished her with the names of corespondents she used in her bill of complaint, were taken by her, he says, from the safe in his office duringr his absence. At the same time, he alleges, she took from a tin box in his bedroom and from the safe books of deposit in savings banks on which, she has drawn $24,695 since she left. She also took, he charges, promissocy notes for $16,000, which he had drawn to her order, but had not given her, and certificates for 10 shares of Crown Cork and Seal Company stock in her name on which she has since drawn $2,800 iu dividends.

With reference to the women whose names and doings Mrs. Colmary alleges she found recorded in the diaries, Mr. Colmary says in his answer that he "respectfully excepts to the impertinent, scandalous and unnecessary matter inserted fn the bill of complaint, reflecting on the character and conduct of a number of women not in any way concerned iu or connected with the controversy."
